UK Trademark Law and Infringement Consequences

Under UK law, the unauthorised use of a registered trademark constitutes trademark infringement. Any exercise professional, training provider, or other parties found to be using our trademarks without a valid licence agreement or membership will be asked to cease and desist immediately. Failure to comply may result in legal action and potential penalties.

If you are currently using any of our trademarks without permission, we kindly request that you stop doing so immediately to avoid potential legal consequences.

Unregistered Trademarks

In addition to our registered trademarks, there may be instances where we use unregistered trademarks to identify our products and services. While unregistered trademarks do not receive the same level of legal protection as registered trademarks, they are still protected under UK law through the common law of "passing off." To succeed in a passing off claim, we must prove that we have established goodwill in the unregistered trademark, that there has been misrepresentation by the infringing party, and that we have suffered damages as a result. We kindly ask that you respect our unregistered trademarks and refrain from using them without our permission.
